1. About ClearDerm and These Terms
1.1 ClearDerm is an online specialist acne clinic operated by Treacy's Skin Solutions Limited, a company incorporated in Ireland (CRO No. 660157), trading as ClearDerm, registered office at 44 Oaklands, Salthill, Galway, H91 PHR9. ClearDerm operates from 7 Odeon House, Eyre Square, Galway, H91 CP5T.
1.2 These Terms and Conditions ("Terms") govern your use of the ClearDerm service and website at clearderm.ie. By booking a consultation or subscribing to any ClearDerm programme, you agree to be bound by these Terms in full. Please read them carefully before you proceed.
1.3 ClearDerm provides GP-led specialist acne care delivered via video consultation and, in the case of the Tretinoin Prescription Service, by asynchronous questionnaire-based assessment as described in Section 5. All clinical services are provided by an Irish Medical Council-registered medical practitioner. ClearDerm is not a hospital, emergency service, or in-person clinic.
1.4 ClearDerm's medical services are exempt from VAT under Schedule 1 of the Value-Added Tax Consolidation Act 2010, as they constitute medical services provided by a registered medical practitioner.
1.5 These Terms are governed by the law of the Republic of Ireland.
2. Definitions
• "ClearDerm", "we", "us", "our" - Treacy's Skin Solutions Limited trading as ClearDerm.
• "Patient", "you", "your" - the person who registers for and uses the ClearDerm service.
• "Your ClearDerm Clinician" - the Irish Medical Council-registered medical practitioner providing your clinical care through ClearDerm, as identified in the Clinician Schedule appended to these Terms.
• "Acne Care Plan" - the monthly subscription programme for standard acne treatment described in Section 6.
• "Isotretinoin Programme" - the monthly subscription programme for isotretinoin prescribing and clinical monitoring described in Section 6.
• "Tretinoin Prescription Service" - the asynchronous, questionnaire-based topical tretinoin prescribing service described in Sections 5 and 9.
• "Pabau" - the clinical management platform operated by Hambrand Technology Ltd (UK), used for scheduling, patient records, questionnaires, consent, and video consultation delivery.
• "HPRA" - the Health Products Regulatory Authority of Ireland.
• "PPP" - the HPRA Pregnancy Prevention Programme applicable to patients prescribed isotretinoin.
3. Eligibility - Who Can Use ClearDerm
3.1 ClearDerm services are available only to adults aged 18 years or over who are resident in the Republic of Ireland.
3.2 The following persons are not eligible and will not be accepted as patients:
• Persons under 18 years of age;
• Persons resident outside the Republic of Ireland, including Northern Ireland;
• Persons who are pregnant or breastfeeding;
• Persons with an absolute contraindication to isotretinoin identified at eligibility screening (including active hepatic disease, hyperlipidaemia, or concurrent tetracycline use) where the Isotretinoin Programme is sought;
• Persons who do not have a named GP registered with a practice in the Republic of Ireland.
3.3 A named GP is a mandatory requirement for all ClearDerm patients. This requirement exists to ensure a primary care clinician is available for emergency escalation, in-person care, and clinical correspondence. This requirement cannot be waived under any circumstances.
3.4 ClearDerm treats adult acne vulgaris, hormonal acne, cystic acne, nodular acne, and scarring acne only. No other medical conditions are assessed or treated through ClearDerm.
3.5 By booking with ClearDerm, you confirm that all personal and medical information you provide is accurate and complete to the best of your knowledge. You confirm that you are who you say you are. Providing inaccurate or false information, including a false declaration of age, residency, pregnancy status, or identity, may affect your clinical safety and may result in the deferral or permanent cessation of your care without refund.
4. Identity Verification
4.1 By booking, you confirm that you are aged 18 or over, that you are a resident of the Republic of Ireland, and that you are the person named in the booking and who will attend all consultations.
4.2 ClearDerm reserves the right to request verification of age and identity at any point during your care. For patients proceeding to the Isotretinoin Programme, photographic identification (current passport, national identity document, or Irish driving licence) is required before the first isotretinoin prescription is issued. Your ClearDerm Clinician may also request identity verification at the initial consultation stage where they have reasonable clinical grounds to do so.
4.3 Where satisfactory identity verification is not provided within the timeframe specified, ClearDerm may defer or decline to issue a prescription. The monthly subscription fee will not commence until identity verification is complete.
4.4 ClearDerm may decline or permanently discontinue care where it reasonably believes any declaration is materially inaccurate. Where discontinuation results from a false declaration, no refund will be issued.
5. The Patient Journey
5.1 The standard ClearDerm patient journey is as follows:
1. Visit clearderm.ie and complete online eligibility screening (18+, Republic of Ireland resident, not pregnant, named GP confirmed).
2. Complete the new patient medical questionnaire and upload skin photographs via the Pabau patient portal.
3. Pay the initial consultation fee of €120 via Stripe and select your appointment time in Pabau.
4. Agree to these Terms and Conditions and the applicable consent form within the Pabau patient portal before your consultation.
5. Attend your initial video consultation with your ClearDerm Clinician.
6. Receive your treatment plan. Where isotretinoin is clinically appropriate, the two-stage Isotretinoin Protocol described in Section 9 applies.
7. Monthly subscription commences after the follow-up consultation at which your first prescription is issued.
5.2 All consultations are conducted by video through the Pabau platform. ClearDerm does not conduct telephone consultations. The Tretinoin Prescription Service does not include a video consultation unless your ClearDerm Clinician requests one, as described in clause 5.4.
5.3 Email support is available at hello@clearderm.ie, Monday to Friday, with a 2-business day response target. This is not an emergency channel.
5.4 The Tretinoin Prescription Service. The Tretinoin Prescription Service is an asynchronous medical assessment. You complete an online medical questionnaire (with optional photograph upload) and your request is reviewed by your ClearDerm Clinician based on the information and any photographs you provide. There is no video consultation unless your ClearDerm Clinician requests one. Payment is for the clinical assessment and does not guarantee that a prescription will be issued. Your ClearDerm Clinician may decline to prescribe, request further information, or recommend a video consultation where clinically appropriate. Repeat prescriptions are subject to clinical review of a renewal questionnaire on each request and are not automatic.
5.5 Where a tretinoin prescription is issued, it will be sent to your nominated pharmacy in the Republic of Ireland via Healthmail (secure clinical email). You pay the pharmacy directly for the cost of the medication, which is separate from and additional to the assessment fee. ClearDerm is not responsible for dispensing delays, stock availability, or any failure by the pharmacy to dispense your prescription.

6.1 All fees are in Euro (€). ClearDerm's medical services are VAT-exempt under Irish law. Fees are subject to change with 30 days' written notice to existing subscribers.
Payment Processing
6.2 All payments are processed by Stripe. ClearDerm does not store your card details. Stripe processes all payment card data under PCI DSS compliance.
Payment Timing
• Initial Consultation Fee (€120): due at booking, before the consultation.
• Blood Test Deposit: due after your initial consultation and before baseline bloods are ordered.
• Monthly Subscription: commences after the follow-up consultation at which your first prescription is issued; recurs monthly thereafter via automatic Stripe billing.
• Tretinoin Assessment Fee: due at the time you submit your assessment or renewal request, before clinical review. The Tretinoin Prescription Service is not a subscription; each assessment is paid for individually and no recurring billing applies.
Subscription Auto-Renewal
6.3 Both subscription plans auto-renew monthly via Stripe until cancelled in accordance with Section 8. By subscribing, you authorise ClearDerm to charge your chosen payment method on a recurring monthly basis until cancellation.
7. Minimum Commitments
7.1 The Acne Care Plan has a minimum commitment of 3 months. Cancellation is not permitted during the first 3 months.
7A Subscription Pause
7A.1 Patients on the Isotretinoin Programme may request a clinical pause of their subscription in the following circumstances only: a medical reason requiring temporary cessation of isotretinoin; a planned period of unavailability for blood monitoring; or another reason accepted at the clinical discretion of your ClearDerm Clinician
7A.2 To request a pause, send written notice to hello@clearderm.ie. A pause takes effect from the first day of the following billing month. Subscription billing is suspended for the duration of the approved pause.
7A.3 The maximum pause duration is three consecutive months. At the end of the approved pause period, billing resumes automatically unless you have provided written notice of cancellation in accordance with Section 8.
7A.4 Resumption of the Isotretinoin Programme following a pause requires a clinical review consultation with your ClearDerm Clinician and, where clinically indicated, repeat baseline blood testing before prescribing recommences. The cost of repeat baseline blood testing, where required, is the patient's responsibility at the rates set out in Section 6.
7A.5 A pause does not constitute cancellation. The minimum commitment provisions of Section 7 apply to the active period of subscription only and are not extended by a pause.
7A.6 Acne Care Plan patients do not have access to the pause mechanism. Patients wishing to pause an Acne Care Plan should cancel in accordance with Section 8 and re-enrol when ready.
7A.7 ClearDerm reserves the right to decline a pause request where, in the clinical judgment of your ClearDerm Clinician, a pause would not be in your clinical interest.
7.2 The Isotretinoin Programme has no fixed minimum term. Monthly charges apply for each calendar month in which you are actively receiving isotretinoin treatment. Duration is determined clinically. The Tretinoin Prescription Service is not a subscription programme: it has no minimum commitment, and the minimum commitment and cancellation provisions of Sections 7 and 8 do not apply to it.
7.3 During any minimum term, monthly subscription fees already charged are non-refundable except as provided in Section 9 or as required by law.
8. Cancellation Policy
8.1 To cancel your subscription, send written notice by email to hello@clearderm.ie.
8.2 Acne Care Plan: cancellation after the 3-month minimum term takes effect 30 days from the date written notice is received by ClearDerm.
8.3 Isotretinoin Programme: cancellation takes effect from the date treatment is clinically discontinued, or at the end of the current billing month following written notice, whichever is later.
8.4 ClearDerm may terminate your subscription with immediate effect if:
• You are no longer clinically eligible for the service;
• You fail to comply with the clinical requirements of your treatment programme;
• You provide false or materially inaccurate information;
• Payment is not received when due;
• Continuation of care would, in the clinical judgment of your ClearDerm Clinician, present a risk to your health or safety.
8.5 Where ClearDerm terminates your subscription for clinical reasons, you will be given appropriate notice and referral advice where clinically indicated.
9. Refund Policy and Your Statutory Right to Cancel
9.1 Statutory Right to Cancel - Consumer Rights Act 2022
Under S.I. No. 595 of 2022 (Consumer Rights Act 2022), you have the right to withdraw from a service contract within 14 days of entering into it (the "Cooling-Off Period") without giving any reason.
By booking your consultation and requesting that the consultation service be performed before the Cooling-Off Period expires, you expressly acknowledge and agree that:
• You are requesting that the service commences immediately;
• Once your initial consultation has taken place, you lose your right to cancel in respect of that consultation and will not receive a refund of the consultation fee;
• You will be charged for any part of the service performed up to the point of cancellation.
The same acknowledgment applies to the Tretinoin Prescription Service: by submitting an assessment or renewal request and paying the assessment fee, you expressly request that the assessment service commences immediately. Once your ClearDerm Clinician has begun reviewing your request, the service has been performed and you lose your statutory right to cancel in respect of that assessment fee.
9.2 Initial Consultation Fee (€120)
Non-refundable once the consultation has taken place.
Full refund if you cancel at least 24 hours before your scheduled consultation.
Non-refundable if you cancel with less than 24 hours' notice or do not attend without prior notice.
9.3 Monthly Subscription Fees
Non-refundable for any calendar month already in progress at the time of cancellation.
9.4 Blood Test Deposit
Non-refundable once blood tests have been ordered by your ClearDerm Clinician. Where blood tests have not yet been ordered, a refund may be considered at ClearDerm's discretion.
9.5 Clinician-Initiated Cessation Refund
Where your ClearDerm Clinician determines that your treatment must cease for clinical safety reasons (including but not limited to an adverse blood result, a PHQ-9 score meeting the threshold in Section 12.5, or a newly identified contraindication), your subscription will be cancelled with immediate effect.
Where clinician-initiated cessation occurs part-way through a billing month for which you have already paid, ClearDerm will issue a pro-rata refund for the unused days of that month, calculated on a 30-day basis. This refund will be credited to your original payment method within 10 business days.
Where clinician-initiated cessation results from information you provided that was false or materially inaccurate, no refund will be issued.
ClearDerm will provide a written summary of the clinical reason for cessation and, where appropriate, a referral recommendation to support your ongoing care.
9.5A Tretinoin Prescription Service - Assessment Fee
The Tretinoin Assessment Fee is payment for the clinical assessment of your request by your ClearDerm Clinician. It is not payment for a prescription, and payment does not guarantee that a prescription will be issued.
Where your ClearDerm Clinician declines to prescribe following a completed assessment, the assessment service has been fully performed and the assessment fee is non-refundable. Where you cancel your request before your ClearDerm Clinician has begun the clinical review, the assessment fee will be refunded in full to your original payment method. Where your ClearDerm Clinician is unable to complete an assessment (for example, because a video consultation is required and you choose not to proceed), ClearDerm may, at its discretion, apply the assessment fee towards the video consultation fee or issue a partial refund.
9.6 Requesting a Refund
All refund requests must be submitted in writing to hello@clearderm.ie. ClearDerm will respond within 10 business days. Approved refunds will be credited to the original payment method within 5–10 business days.
10. Missed Appointments
10.1 To reschedule or cancel an appointment, give at least 24 hours' notice by email to hello@clearderm.ie or via the Pabau patient portal.
10.2 Appointments cancelled with less than 24 hours' notice, or not attended without notice, may be charged in full at the applicable consultation rate.
10.3 Missed follow-up consultations included within your monthly subscription will not be credited or carried forward.
10.4 For Isotretinoin Programme patients: a missed monthly follow-up may result in a clinical decision by your ClearDerm Clinician not to renew your prescription until you have attended. No prescription will be issued without a clinical review within the preceding month.
10.5 Missed Appointments: Where a consultation cannot proceed due to a technical failure attributable to the ClearDerm platform or the Pabau video system, the appointment will be rescheduled at no additional charge and no cancellation fee will apply. Where a technical failure is attributable to the patient's own device or internet connectivity, the standard cancellation and missed appointment policy in this Section applies
11. Clinical Services
11.1 Your ClearDerm Clinician
All clinical services are provided by Your ClearDerm Clinician, an Irish Medical Council-registered medical practitioner. Details are set out in Schedule 1 (Clinician Schedule) appended to these Terms.
11.2 Standards of Care
ClearDerm provides clinical services to the standard of a reasonably competent GP with postgraduate dermatology training. All prescribing is conducted personally by a registered medical practitioner following direct clinical review.
11.3 No Automated Prescribing
ClearDerm does not use automated or algorithmic prescribing. All prescriptions, including those issued through the Tretinoin Prescription Service, are issued personally by Your ClearDerm Clinician following individual clinical review.
11.4 GP Communication
Your named GP will receive a clinical information letter at the commencement and conclusion of your treatment. This letter is for information purposes only. Your GP is not a party to your ClearDerm treatment and bears no monitoring responsibility for your ClearDerm care. All clinical responsibility rests with Your ClearDerm Clinician.
11.5 Email Support
Direct email access at hello@clearderm.ie, Monday to Friday, 2 business day response target. This is not an emergency channel and must not be used to report urgent or serious symptoms.
11.6 Clinician Unavailability
ClearDerm is currently operated by a sole clinician. In the event of planned or unplanned clinician unavailability (including illness, bereavement, or other personal circumstances), ClearDerm will notify affected patients as promptly as reasonably practicable.
Where clinician unavailability will result in a delay to a scheduled consultation or prescription, ClearDerm will: notify you by email at the address held on your account; reschedule your consultation at the earliest available date; and, where a prescription renewal is time-critical, take reasonable steps to facilitate continuity of prescribing or to refer you to an appropriate alternative provider.
Monthly subscription fees will not be charged for any full calendar month during which ClearDerm is unable to deliver its service due to clinician unavailability. Where fees have already been charged for such a month, a pro-rata credit or refund will be issued.
This clause will be updated as ClearDerm's clinical team expands.
11.7 Prohibition on Recording
All video consultations, clinical communications, and correspondence between you and ClearDerm are confidential. You must not record any consultation, in whole or in part, without the prior written consent of your ClearDerm Clinician. Unauthorised recording of consultations may result in the immediate termination of your care without refund.
ClearDerm may, with your express prior consent, record consultations for clinical quality and safety purposes. You will be informed of any such recording at the start of the consultation and recording will only proceed with your explicit agreement. Details of how consultation recordings are stored and used are set out in the Privacy Notice.
ClearDerm delivers its services remotely, by video consultation or, for the Tretinoin Prescription Service, by asynchronous questionnaire-based assessment. Clinical assessment is based on visual assessment (including any photographs you submit), patient-reported history, and clinical information provided by you. A physical examination cannot be performed. By proceeding with ClearDerm, you acknowledge and accept this limitation as an inherent feature of telemedicine-based care. Where your ClearDerm Clinician considers that an in-person assessment is clinically necessary, they will advise you accordingly.
12. Isotretinoin - Special Provisions
12.1 Isotretinoin is a powerful prescription medicine. Its prescription and monitoring by ClearDerm is governed by HPRA requirements and the Pregnancy Prevention Programme (PPP).
12.2 Blood Monitoring Patient Compliance Obligation - Attendance at monthly blood monitoring is a mandatory condition of the Isotretinoin Programme. Where a patient fails to attend or provide required blood test results within the timeframe specified by your ClearDerm Clinician, no prescription will be issued for that month. Monthly subscription fees remain payable regardless of prescription status where the delay is due to patient non-attendance
12.3 ClearDerm follows a two-stage clinical protocol before any isotretinoin prescription is issued:
• Stage 1 - Initial Consultation: Acne severity assessed, full history taken, eligibility evaluated. No isotretinoin prescribed at this stage.
• Stage 2 - Follow-Up Consultation: Proceeds only when all baseline blood results have been received and reviewed, and all HPRA PPP requirements are satisfied for female patients of childbearing potential. First prescription issued only if all criteria are met.
12.4 For female patients of childbearing potential, the HPRA PPP requires:
• One confirmed negative serum beta-hCG (blood) pregnancy test, taken within 3 days before the first prescription is issued and at least one month after effective contraception has commenced.
• Two confirmed effective forms of contraception in use for at least one month before treatment and throughout treatment and for one month after treatment ends;
• Monthly serum beta-hCG testing before each prescription renewal;
• Signing of the HPRA Acknowledgement of Teratogenic Risk before the first prescription is issued.
12.5 No isotretinoin prescription will be issued without a monthly clinical review and a confirmed negative pregnancy test (female patients) received and reviewed by Your ClearDerm Clinician. There are no exceptions.
12.6 ClearDerm conducts a PHQ-9 mood assessment before every follow-up consultation. A score of 15 or above, or positive Question 9, will result in immediate cessation of treatment, provision of crisis resources, and notification of your GP.
12.7 Prescriptions will be issued electronically to your nominated pharmacy via secure clinical communication. You are responsible for nominating a pharmacy in the Republic of Ireland at or before your prescribing consultation. ClearDerm is not responsible for dispensing delays, stock availability, or any failure by the pharmacy to dispense your prescription.
13. Emergency and Out-of-Hours Care
13.1 ClearDerm is not an emergency medical service and cannot provide emergency care.
13.2 In a medical emergency, you must immediately: call 999 or 112; attend your nearest Emergency Department; or contact your named GP. You must not contact ClearDerm as a first point of contact in a medical emergency.
13.3 If you experience a serious or unexpected side effect to any ClearDerm-prescribed medication, stop taking the medication and contact your GP or attend the Emergency Department immediately.
14. Treatment Outcomes
ClearDerm does not guarantee any particular clinical outcome. Treatment response varies between individuals. All clinical content and marketing materials describe typical or likely outcomes and are not guarantees of results.
15. Data Protection
ClearDerm processes your personal data and health data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018. Your health data is special category data under GDPR Article 9. Full details are in our Privacy Notice at clearderm.ie/privacy-policy.
ClearDerm uses third-party data processors including Pabau (clinical management platform) and Stripe (payments) to deliver its services. Details of all processors and the safeguards governing data transfers are set out in the Privacy Notice at clearderm.ie/privacy-policy.
16. Medical Indemnity
Your ClearDerm Clinician carries professional medical indemnity insurance with the Medical Protection Society (MPS), Membership Number 440308.
17. Limitation of Liability
17.1 Nothing in these Terms limits or excludes ClearDerm's liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded under Irish or EU law, including under the Consumer Rights Act 2022.
17.2 Subject to 17.1, ClearDerm's total liability will not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.
17.3 ClearDerm is not liable for any delay or failure caused by events outside our reasonable control (force majeure), including communications failures.
18. Intellectual Property
All content on the ClearDerm website, including text, graphics, logos, clinical information, and documents, is the intellectual property of Treacy's Skin Solutions Limited or its licensors. No content may be reproduced, distributed, or used without prior written consent.
19. Complaints
19.1 Complaints should be raised first with your ClearDerm Clinician at hello@clearderm.ie. We will acknowledge within 5 business days and aim to resolve within 20 business days.
19.2 If your complaint is not resolved to your satisfaction, you may refer to:
• Irish Medical Council - clinical conduct of the treating clinician;
• Data Protection Commission (DPC) - data protection concerns (dataprotection.ie);
• Competition and Consumer Protection Commission (CCPC) - consumer rights concerns (ccpc.ie).
20. Amendments
ClearDerm may amend these Terms from time to time. Material changes will be notified by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not accept updated Terms, you may cancel in accordance with Section 8.
21. Governing Law
These Terms are governed by the law of the Republic of Ireland. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
